After 15 sacked senate members of Kerala University move court, HC asks governor not to make fresh appointments

The Kerala High Court, while considering the matter today, asked the Governor not to make any fresh nominations in place of the petitioners. The matter will be considered again on October 31.

Following the decision of Governor Arif Mohammad Khan as the Chancellor of the University of Kerala, to remove the 15 Senate members of the University, all the members have now approached the State High Court. He claimed that the governor’s move was against the law. The Kerala High Court, while considering the matter today, asked the Governor not to make any fresh nominations in place of the petitioners. The matter will be considered again on October 31.

A syndicate meeting was called on 11 October which saw the attendance of 13 members, while many refrained from attending the meeting, due to which it was canceled due to lack of quorum. Khan had ordered the removal of Senate members after ignoring his repeated instructions to hold a Senate meeting and provide a Senate nominee for the search-cum-selection committee.

Senate members who approached the court said the decision was against the law of the university. He also said that the Governor had on August 8 issued an order appointing two members for the search-cum-selection committee of the new Vice-Chancellor in the University of Kerala. The members said that this order is also against the rules of the university.

The selection committee was to appoint the vice-chancellor. Raj Bhavan issued a notice of expulsion by VC VP Mahadevan Pillai for not complying with the Governor’s order to withdraw 15 members from the Senate.

before, Kerala Chief Minister Pinarayi Vijayan said the Governor’s decision was not in accordance with the law. “The steps he took were not in accordance with the law. Some members of the Senate were ex-officio and the law does not give them the right to remove them. Vijayan also said that the chancellor should take a stand which is good for the healthy development of universities.
