Prayagraj: Ani Allahabad High Court judge, Justice Sunita Agarwalrecused himself from hearing a writ petition filed by wife and daughter on Monday Javed Mohammed Javed Pump, an accused in the June 10 violence in Prayagraj that erupted after Friday prayers against the demolition of his house by the district administration and Prayagraj Development Authority (PDA).
When the writ petition was filed on Monday Parveen Fatima And Sumaiya FatimaJaved Mohd’s wife and daughter came for hearing respectively before a division bench headed by Justice Sunita Agarwal, the court said, “Let this matter be placed before another bench, not one of us (Justice Sunita Agarwal). a member.”
Accordingly, the court after receiving the nomination from the Chief Justice directed that the matter be placed afresh before another Bench on June 28, 2022.
The petitioners have demanded compensation and punishment to the guilty officers in the writ petition. Further, as an interim measure, he has requested the court to direct the state government to arrange a government accommodation for them till the house is rebuilt.
Further, he has requested the court to direct the state government to pay compensation for his illegal arrest and detention and for violation of his fundamental rights under Article 21 (protection of the right to life and personal liberty) of the Constitution of India. Give instructions
In the writ petition, it is alleged by both the petitioners – Javed’s wife and daughter – that around midnight on June 10, 2022, the police forcibly took them to the Mahila police station and kept them in custody for three days.
According to the petitioners, the demolition was against the law as the house did not belong to Javed but belonged to his wife Parveen Fatima, who had received it as a gift from her parents even before their marriage.
The petitioners allege that the PDA did not give any notice. A notice, with the house number, was addressed not to Parveen Fatima, but to her husband Javed, who was arrested on June 10 for allegedly inciting violent protests against derogatory remarks targeting the Prophet .
The petition claimed that the house was gifted to Parveen by her parents before marriage and she was paying house tax and water tax from time to time. Even tax receipts were issued in his name. However, no notice was issued in his name before the house was demolished.
Javed was arrested on the night of June 10 in connection with the registration of an FIR at police station Khuldabad in Prayagraj district and the PDA had decided to bulldoze his house at JK Ashiana in Kareli area of ​​Prayagraj. After this his house was demolished on 12 June.
