BangaloreA 22-year-old student was sentenced to five years simple imprisonment and fined Rs 25,000 for making derogatory remarks on a Facebook post after the terrorist attack on CRPF jawans in Pulwama in 2019.

The order was passed by a special court in Bengaluru.

The court found him guilty under sections 153A (promoting enmity between different groups on grounds of religion) and 201 (causing disappearance of evidence).

However, Section 124A (sedition) was not prosecuted and was kept in abeyance as per the directions of the Supreme Court keeping it in suspension.

The order was passed by Judge Gangadhar CM of the Additional City Civil and Sessions Judge (Special Judge for trial of NIA cases).

The accused Faiz Rashid was 19 years old and a college student at the time of crime and is in custody for three and a half years.

He was sentenced to simple imprisonment for three years and to pay a fine of Rs 10,000 for the offense under section 153-A of the IPC. He was sentenced to simple imprisonment for a term of three years and a fine of Rs 5,000 for the offense under section 201 of the IPC.

He was sentenced to five years and fined Rs 10,000 for the offense under section 13 of the Unlawful Activities (Prevention) Act. The decorations will go together.

Since he was 19 at the time of committing the crime, Rasheed was eligible for probation.

His lawyer argued that he was below 21 years of age and had not committed any other offense and should be released on probation.

The court, however, cited reasons for denying him probation and sentenced him to imprisonment.

It argued that this was a deliberate act by Rasheed.

“The accused has not made derogatory remarks once or twice. He commented on all the posts made by all the news channels on Facebook. Also, he was not an illiterate or an ordinary person. He was an engineering student at that time. Commission and he made deliberate posts and comments on his Facebook account,” the court observed.

The court observed that the accused “felt pleasure about the killing of great souls and celebrated the death of great souls (if) he was not an Indian. Therefore, the crime committed by the accused is against this great nation and is heinous.” Nature.”
