The court of Samastipur Special Judge cum ADJ (III) Pranav Kumar Jha soon sent both the brothers to judicial custody, holding them guilty of the deadly attack on the CPM leader.
Advocate Manoj Kumar Gupta, appearing in the court on behalf of the CPM leader, told TOI over phone that the matter regarding quantum of punishment against the guilty persons would be heard on September 13.
Gupta said that in the year 2000, CPM leader Lalan Singh had lodged an FIR against Ram Balak Singh and Lal Babu Singh in Bibhutipur police station under sections 341, 323, 307, 34 IPC and 27 Arms Act. The court found Ram Balak and his brothers guilty under sections 324 (voluntarily causing hurt by dangerous weapons or means) of the IPC and section 27 of the Arms Act.
Earlier, the police had acquitted Ram Balak and his brother from all the charges mentioned in the FIR while filing the charge sheet in this case. Consequently, the CPM leader moved the court and prayed for framing of charges against Ram Balak and his brother, the CPM leader’s counsel said. The court accepted the prayer of the CPI(M) leader.
Ram Balak represented Bibhutipur (Samastipur) Assembly seat twice in 2010 and 2015.
