‘Centre not implementing transfer of its service secretary’, AAP moves Supreme Court

In Delhi, the Aam Aadmi Party-led government on Friday moved the Supreme Court alleging that the Center was not implementing the transfer of its service secretary. CJI DY Chandrachud said that he would constitute a bench to hear the matter next week.

This came a day after the apex court ruled that the Delhi government Legislative and Executive Powers On administration of public order, police and services except land.

Senior advocate AM Singhvi, appearing for the Delhi government, mentioned the matter before a bench of Chief Justice and Justice PS Narasimha, saying that the apex court had delivered the verdict only yesterday and now contempt can happen, as per PTI reports.

He said that the order of this court may amount to contempt and a bench needs to hear it urgently under Article 141 of the Constitution.

“Saying that we will not transfer anyone. In view of the judgment given yesterday, I may file a contempt case. But it will take time. So please list the matter,” he added.

The Delhi Government on Thursday removed Ashish More, Secretary, Services Department, Government of Delhi. Chief Minister Arvind KejriwalEarlier, in a press conference, warned of action against officials who obstruct public works.

Former Delhi Jal Board CEO AK Singh, a 1995-batch (AGMUT cadre) IAS officer, will replace More.

A five-judge constitution bench headed by the CJI delivered the unanimous verdict, ending an eight-year-old dispute between the Center and the Delhi government.

Before the court’s decision, the service department was under the control of Lieutenant Governor of Delhi,

CM Kejriwal had said earlier also that the pace of work in the national capital will increase manifold. He further declared that the officials who “obstructed” the work of the people would soon “face the loss”.
