The Supreme Court on Friday said that there should be no special stray round of counseling for all in the decision of the Center and the Medical Counseling Committee (MCC). The top court said that the MCC and Union of India will have to follow the timetable to complete the admission process when the current admission of NEET-PG-2021 is already behind the schedule.

When a conscious decision is taken by the Central Government/Medical Advisory Committee not to hold another special stray round of counselling, it cannot be said that it is arbitrary,” the bench said. The top court said that almost a year after the academic session and after eight to nine rounds of counselling, students cannot pray for admission on vacant seats, which are mostly non-clinical.

Apart from the fact that after the closure of the last round of counseling on May 7, 2022, the entire software mechanism has been switched off and the security deposit has been refunded to the eligible candidates, it is to be noted that for NEET Admission process- PG-2022 has started, NEET-PG-2022 results have been declared on June 1, 2022, and as per the timetable, the counseling process is going to start in July 2022, the bench said. Therefore, if an additional special stray round of counseling is conducted now as per the prayer, in that case, it may affect the admission process for NEET-PG-2022, the apex court said.

In view of the above and for the reasons stated above, the petitioner is not entitled to any relief from the mandamus directing the respondents to conduct special stray round of counseling to fill up the remaining vacant seats of NEET-PG-2021. Now giving such relief can affect medical education and ultimately public health as seen above. In these circumstances, both these writ petitions and special leave petitions are liable to be dismissed and accordingly dismissed, the bench said.
