Delhi government takes initiative to bring back detention policy in schools

New Delhi: The Directorate of Education (DOE) has issued a circular stating that the Right of Children to Free and Compulsory Education in Delhi Rules 2022 has been amended, which is a step towards bringing back the detention policy in schools.

It will come into force as soon as it is notified in the Gazette.

After the gazette notification, the government will issue the manner and conditions for placing a child back in his/her current class.

“In exercise of the powers conferred by section 38 read with sub-section 3 of section 16 of the Right of Children to Free and Compulsory Education (RTE) Act 2009, the Lieutenant Governor, hereby, to amend the right of make rules. Free and Compulsory Education to Children Rules 2011. This rule may be called the Delhi Children’s Right to Free and Compulsory Education (Amendment) Rules, 2020.

The manner and conditions under which a child may be kept back under sub-section (3) of section 16 shall be notified by the Government.

In 2009, the RTE Act introduced a no-detention policy under which students up to class 8 were to be promoted. To ensure quality education, Continuous and Comprehensive Evaluation was introduced, but was canceled in 2017 due to poor implementation.

In 2019, the Delhi government had approved the constitution of a committee to remove the no-detention policy, following an amendment to the Act by Parliament.
