Delhi High Court refuses to hear PIL seeking removal of police booths on footpaths

The Delhi High Court has refused to entertain a Public Interest Litigation (PIL) seeking removal of all police booths built arbitrarily and illegally on the footpaths and roads of Delhi.

The petition of the NGO named ‘Jan Seva Welfare Society’ states, “Construction of police booths on footpaths/roads by Delhi Police has resulted in serious inconvenience and danger to the life and safety of the general public and residents of Delhi. Therefore, the petitioner To protect the fundamental rights (right to life) of pedestrians guaranteed under the Constitution of India and against arbitrary and illegal acts of Delhi Police.

It is also stated that the police booths are equipped with all facilities like ACs, LED display boards and are equipped with illegally obtained water and electricity connections, which is also evident from the report of the district PIO which filed an application under the RTI Act. , which states that hardly 10 to 15% of police booths have valid water and electricity connections.

A division bench of Justice DN Patel and Justice Jyoti Singh on Monday declined to consider the matter and asked the petitioner to withdraw it otherwise the price, the petitioner may be fined. Later, the counsel for the petitioner NGO withdrew the case.

Further, the petitioner has directed the Delhi Police in contravention of its own circular dated November 23, 2005 issued by its headquarters regarding eligibility for installation of air conditioners in Delhi offices, to all ACs and display boards installed in the Delhi Police offices. Advocate Banke Bihari, appearing for the petitioner, submitted that the higher authorities of Delhi Police should report to this court about the outstanding payment of electricity and water bills against the Delhi Police and ensure that the payment of water bills and electricity bills The arrears should be paid.
