DIAL, Bird ExecuJet receive copyright infringement notices

A sessions court in New Delhi has issued notice to Bird Execute Airport Services Pvt Ltd. Ltd. (a Bird Group company), concessionaire to the General Aviation Terminal of Delhi, and Delhi International Airport Ltd. (DIAL), in an alleged case of criminal breach of trust, data theft and breach of copyright laws.

Mark Martin, chief executive of aviation consulting firm Martin Consulting LLC, has accused BirdExecuteJet and Dial of theft of proprietary data in collusion with Navjot Singh, a former employee of the consulting firm.

Justice Narottam Kaushal, Principal District and Sessions Judge, South West District Dwarka Court, has asked Bird Executioner, Singh and Dial to respond by December 2. Mint has reviewed the copy of the notice.

In March 2018, Bird ExecuteJet hired Martin Consulting to design the apron and terminal of the country’s first General Aviation Terminal (GAT) for chartered flights commencing operations on 18 September 2020.

“Martin Consulting claims that a former employee was in collusion with BirdExecujet and DIAL and that copyright and IP (intellectual property) were passed on. This action was taken after the agreement (between BirdExecujet and Martin Consulting) in December 2019 ) terminated automatically.

“Martin says that Bird has not formally terminated the contract till date,” said Bharat S Kumar, associate partner at Saikrishna & Associates, representing Martin Consultancy.

The contract between Bird Executing and Martin Consulting was to automatically expire within 21 months from the signing date of 1 March 2018.

“There is sufficient evidence on record to confirm that there has been an unauthorized exchange of data by and between the parties. An FIR (First Information Report) should be filed for a thorough investigation.”

Kumar said Mark Martin received three emails (dated January 14, January 16 and January 17, 2020) from the company’s servers, addressed to Singh by Bird Executioner executives, on charges of data theft and Intellectual Property Rights (IPR). pointed to the violation. He said Singh left Martin Consulting on 2 October 2019.
