New Delhi: The Delhi University Students’ Union (DUSU) has approached the Delhi High Court challenging the university’s decision to consider only class 12th marks for admission to Kerala State Board students, who are studying in class XI and XII. The grade is determined by combining the marks. Justice Prateek Jalan asked DUSU’s counsel to satisfy the court on the jurisdiction of the union to file the petition on the next date of hearing on November 10.

Since the university’s lawyers were not present in the hearing, the court asked DUSU’s counsel Ashish Dixit to give a copy of the petition to them.

DUSU, in its plea, said that it is approaching the High Court against the “arbitrary, irrational and unfair conduct” of the authorities, who have violated the fundamental and legal rights of innumerable students.

It said that in terms of the relevant policy, some state boards, including the Directorate of General Education (Higher Secondary Wing), Government of Kerala, give combined marks of both XI and XII on the marksheets.

The policy clearly states that for determining the grades of the students, the combined marks of both XI and XII shall be considered.

The petition, filed through advocate Ashish Dixit, said that the University of Delhi for several years has similarly incorporated a provision in the admission bulletin which states that in cases where the state boards publish the marks of both class XI and XII, the students qualification shall be determined on such consolidated basis. “Respondent No. 2 (DU), in its admission process of 2021-2022, has unilaterally and arbitrarily decided that students will be required to fill only Class XII marks. When the admissions for the session 2021-2022 began, the colleges raised and expressed objection with respect to the mark sheets containing both the XI and XII marks,” it said.

The petition states that initially, the university directed that such cases be put on hold, however, within a few hours, the admission office of DU circulated an email to the colleges, stating that the admission advisory committee had It has been decided that only class XII marks will be there. It said that the state boards declared the results as per the long standing policy which was notified for the examinations conducted for the academic session 2020-2021.

It said that the union made a representation to the authorities and met the highest officials of the university but they did not work in any way for the welfare of the students following which the petition was filed.

Earlier, the High Court had dismissed a petition alleging “proportionate” number of admissions of Kerala State Board students in Delhi University, saying it was a matter of the university’s admission policy to fix the cut-off .

The earlier petition was filed by a DU candidate seeking a “scaling mechanism” for marks obtained by students of different boards so as to provide a level playing field.
