Fake letter used to cancel gift deed, get compensation of ₹13.68 cr for OSR land acquired by NHAI: DVAC

A forged letter was allegedly used to cancel a gift deed of handing over 5.13 acres of OSR land in a residential layout in Nemili to claim compensation of ₹13.68 crore as compensation from the National Highways Authority of India .

The Directorate of Vigilance and Anti-Corruption arrested industrialist VGS Amaldas Rajesh, one of the partners of VGP Investments Ltd; Of. Narmada, the then Special District Revenue Officer (Land Acquisition), National Highway (Chennai-Bangalore Express Highway); P. Meena and P. Gomathi, the then Special Tehsildar (Land Acquisition), Sriperumbudur; The then sub-inspector of the survey of Kanchipuram district, R.K. Varadarajan; R. Ravi, the then Sub-Registrar (In-Charge), Sriperumbudur; and others in collusion causing a loss of ₹13,68,18,871 to the highway authorities.

The DVAC case is that VGP Investments Limited made a layout of house sites in Nemili and Ayakolathur villages of Sriperumbudur taluk in Kancheepuram district. The company registered OSR land or common area to the extent of 2,24,016 square feet in two villages in favor of the Commissioner, Panchayat Union, Sriperumbudur.

In the year 2017, NHAI started land acquisition to widen the existing Chennai-Bengaluru National Highway from Sriperumbudur to Bengaluru to a four-lane expressway. Mr. Rajesh, one of the partners in the partnership firm of VG Panneerdas & Co. and VGP Investments Ltd., with the malafide intention of obtaining compensation from the Government, made a forged deed of OSR land in Kancheepuram district.

VGP Investments Limited and some real estate brokers created a fake letter in the name of the Block Development Officer, Sriperumbudur, addressed to the Sub-Registrar, Sriperumbudur, on January 4, 2018, mentioning 2,24,016 square feet of open space. The DVAC in its First Information Report stated that the land for public use was erroneously given in the gift deed and there was no objection from the BDO/Commissioner, Sriperumbudur for cancellation of the gift deed.

On the same day, the Sub-Registrar, Sriperumbudur registered a cancellation deed ex-parte without any government order or verifying the veracity of the NOC. The accused persons then approached the highway authorities and obtained compensation amount for land acquisition. The DVAC said that the sub-registrar, who was aware of the OSR registration deed, got it canceled thereby paving the way for the real estate brokers to receive huge compensation and personal gains from the government.

The probe agency has accused the Special DRO and Special Tehsildars of colluding with industrialists and real estate brokers and initiating proceedings to obtain compensation. The Special DRO, who was the competent authority, sanctioned the compensation without application of mind causing wrongful loss to the Government.
