Panaji: The High Court of Bombay at Goa has directed the Additional Director of Panchayat-II, South GoaTo file an affidavit within five days, explaining the stay on 45 demolition orders passed by Chikalim Panchayat.

The High Court highlighted one such stay order passed by the Additional Director of Panchayats-II, South Goa on April 4, which fixed the next hearing on June 30. Similar orders were passed in 44 other cases.
The High Court pulled up the Additional Director for fixing the next hearing after nearly two months.
“…we find that the Additional Director of Panchayats has not given any reason for granting the stay and has fixed the next date after about two months,” the court said.
The High Court said that perhaps, the Additional Director was not apprised of the issue of safety and security implications and various orders passed by the court and public interest to ensure that there is no threat to aviation safety and security.
A division bench of Justice Mahesh Sonak and Justice RN Laddha said, “At least prima facie, it appears to us that the Additional Director of Panchayats has passed the stay order without any mind and without assigning any reason.”
High Court directed Mormugao Planning and Development Authority To take all the appeals on priority basis and dispose them off within one month.
The court noted that the planning authorities had opposed the action, where there was an allegation that the MPDA failed to act when unauthorized constructions were taking place and the naval and aviation authorities lodged their protest. “After all, without going into such accusations, we found examples of passivity.”
In January, the High Court said that the panchayat could not consider regularizing the 46 illegal structures that have flourished in Goa internationally. air port and reprimanded the Panchayat for passing the resolution saying that regularization can be considered if the occupants submit NOCs from the Naval and Planning authorities.
The High Court had noted that unauthorized structures have come up in the funnel zone or other prohibited areas around the airport posing a serious threat to aviation security.
