HC dismisses DU’s plea challenging DU’s decision to consider only Class 12 marks for admission – Times of India

New Delhi: The Delhi High Court on Friday dismissed the plea of Delhi University Students’ Union (DUSU) challenging the university’s decision to consider only Class 12th marks for admission to Kerala State Board students. which determines the grade by combining the marks of class XI. and twelfth.

A bench of Justice Vipin Sanghi and Justice Jasmeet Singh observed that the petition has been greatly delayed and lacks merit.

Congratulations!

you successfully cast your vote

The court said it cannot pass any order on the presumptions and will see whether some students from Kerala file a petition with a complaint. “They have changed it so changed it, how can one bother about it… If you don’t want to read the clear writing on the wall, it is your choice,” the bench said in a June release issued by DU. Referring to the bulletin, he said. Which states that if a candidate’s mark sheet has both XI and XII marks, then he/she will enter class XII marks only.

DUSU, in its plea, said that it is approaching the High Court against the “arbitrary, irrational and unfair conduct” of the authorities, who have violated the fundamental and legal rights of innumerable students.

It said that in terms of the relevant policy, some state boards, including the Directorate of General Education (Higher Secondary Wing), Government of Kerala, give combined marks of both XI and XII on the marksheets.

The policy clearly states that the combined marks of both XI and XII will be considered for determining the grades of the students.

Advocate Ashish Dixit, representing DUSU, submitted that Delhi University has for many years incorporated the provision in the admission bulletin, which states that in cases where state boards publish marks of both XI and XII, such consolidated marksheets Based on the merit of the students will be determined.

However, the Delhi University in its admission process for 2021-2022 has unilaterally and arbitrarily decided that students will be required to fill only Class XII marks, he said, adding that when admissions began for the session 2021-2022, colleges would raised and raised objection with respect to the mark sheet containing the marks of both XI and XII.

The plea was opposed by Delhi University’s counsel M Rupal, who objected to DUSU’s right to file the petition as the association only represents the students of Delhi University and not those who have not yet taken admission here.

He further said that the admission bulletin was issued by the university in June and the petitioner had approached the court in October, which is too late.

Dixit, however, said the issue was first highlighted on October 4, then he has a report with the Vice-Chancellor on October 9, but no decision has been taken till date.

The plea said that initially, the university directed that such cases be put on hold, however, within a few hours, the admission office of DU circulated an email to the colleges, stating that the admission advisory committee had It has been decided that only Class XII marks will be considered. ,

It said that the state boards declared the results following a long-standing policy, which was notified for the examinations conducted for the academic session 2020-2021.

It said that the union made a representation to the authorities and met the highest officials of the university, but they did not act in any way for the welfare of the students following which the petition was filed.

Earlier, the High Court had dismissed a petition alleging “proportionate” number of admissions of Kerala State Board students in Delhi University, saying that fixing the cut-off is a matter of admission policy of the university. Was.

The earlier petition was filed by a DU candidate, seeking a “scaling mechanism” for marks obtained by students of different boards to provide a level playing field.
