The order was passed by DK Upadhyay and Misc. Saurabh Srivastava KP Khandath while hearing a PIL filed by Anil Kumar. The petition challenged the proposal under which land was prepared for construction of borewell and over head tank under Jal Adhikar Mission in Bargawan village of Sitapur.

It was claimed on behalf of the petitioner that a large number of trees are planted on the said land, out of which bore wells and over head tanks will be cut. On the petition, the state government replied that so far one neem, three chilwal and one Badhal tree, whose age was about two years, has been removed from the said land.

Said that apart from this no tree has been felled so far nor any other tree needs to be felled for the construction work. The court, following this reply, filed the petition, ordering that if removal of a tree is necessary, consider two trees instead of one.
