LIC IPO share allotment: SC refuses to grant relief on pleas seeking stay

The Supreme Court today refused to grant any interim relief and stay the IPO share allotment of Life Insurance Corporation (LIC) on petitions filed by some policy holders. A bench of Justices DY Chandrachud, Surya Kant and PS Narasimha said the court should hesitate to grant any interim relief in cases of commercial investment and IPOs.

“We are not inclined to grant any interim relief”, the bench said, as it had issued notices to the Center and LIC on petitions seeking their replies within eight weeks.

The bench said that on the aspect of interim relief, the court has to be prima facie guided by the well-established principle of the case, balance of convenience and whether there is any irreparable loss.

The LIC IPO is open for retail and other investors on May 4 and is to be allotted on Thursday.

The bench said that a petition has challenged the interim order passed by the Bombay High Court and disposed of it saying that the writ petition before the High Court shall be transferred to the Apex Court.

The top court referred the batch of petitions to a constitution bench with a pending matter on the issue of passing the Finance Act, 2021 as a money bill.
