‘Matter of grave concern’: Kiren Rijiju on SC order on making public of RAW, IB inputs

Union Law and Justice Minister Kiren Rijiju on Tuesday reacted to the Supreme Court’s decision to make public the RAW and Intelligence Bureau (IB) reports on the appointment of judges in high courts. Kiren Rijiju said that keeping such details in the public domain is a “matter of grave concern”. “Putting secret reports in the public domain is a matter of grave concern,” he said.

Responding to the recent comments made by the Supreme Court regarding the delay in appointments on the recommendations of the Collegium, Kiren Rijiju said that these are administrative orders.

“No one should comment on judicial orders. But, these are administrative orders and not judicial ones. I have seen some tweets in which it is contemptuous to comment about NJAC. Kiren Rijiju said that the order of the bench is completely different and it is all administrative.

A few days ago, the Supreme Court Collegium resolved to reiterate its recommendation of November 11, 2021 for the appointment of Saurabh Kirpal as a judge of the Delhi High Court and stressed that it needs to be acted upon swiftly.

The Collegium later referred to the Law Minister’s letter which states that although “homosexuality is decriminalized in India, same-sex marriage is still a codified statutory law or uncodified personal law in India and the candidate’s” enthusiastic participation and denied recognition. passionate attachment to gay rights” will not rule out the possibility of bias and prejudice.

“With regard to the first objection, the two communications of RAW do not reflect any apprehension with regard to personal conduct or behavior of Saurabh Kirpal’s accomplice impinging on national security. There is no reason to presuppose that partner candidate, who is a Swiss citizen, will behave hostile towards our country as his country of origin is a friendly nation,” the SC collegium clarified.

“Several persons in high positions including present and past holders of constitutional posts have spouses who are foreign nationals. Therefore, in principle, there can be no objection to the candidature of Saurabh Kirpal on the ground that his partner is a foreign national. foreign nationals. With regard to the second objection, it needs to be noted that the judgments of the Constitution Benches of this Court have established the constitutional position that every individual is entitled to maintain his/her dignity and individuality irrespective of sexual orientation,” SC Collegium Told.

The SC collegium said, “The fact that Saurabh Kripal has been open about his orientation is a matter which goes to his credit. As a potential candidate for the judiciary, he has not been secretive about his orientation.” are not.”

The recommendation approved by the Supreme Court collegium was sent back for reconsideration. The proposal is reportedly pending for more than five years. In view of RAW’s letter dated 11th April 2019 and 18th March 2021. It said it appeared that there were two objections to the recommendation, adding that “the partner of Saurabh Kirpal is a Swiss citizen, and he is in an intimate relationship and is open about his sexual orientation”.

Addressing a press conference on the awards of e-courts projects, Kiren Rijiju also said that the appointment of judges is an administrative matter and not a judicial matter. He expressed his happiness at the “good” work done by the Justice Department.

Talking about pendency of cases, Kiren Rijiju said that pendency of cases means justice delayed, which is justice denied. He said, “The total pendency in the country is 4 crore 90 lakh cases. Pending cases means delayed justice. Delayed justice, justice denied.

“Delivery of justice is an important aspect. The only way to reduce the pendency is a coordinated effort by the government and the judiciary. The pendency of a large number of cases is a matter of concern. Pendency of cases is a major concern, technology a major solution. We are also looking at alternative dispute resolution and arbitration,” Kiren Rijiju said.
