NEET PG counselling: Supreme Court to hear plea to decide validity of EWS, OBC reservation in medical college admissions

Supreme Court to hear today a petition on the validity of reservation for EWS and OBC candidates National Eligibility cum Entrance Test (NEET) PG 2021 Counselling. The top court will hear a petition challenging the 27 per cent reservation for Other Backward Classes (OBC) and 10 per cent for Economically Weaker Sections (EWS) under the All India Quota (AIQ).

To determine the eligibility of EWS, the Center had introduced the criteria of annual income of Rs.8 lakh. This was achieved after due deliberations within the Ministry of Social Justice and Empowerment and the live law was reported by all concerned stakeholders.

The Center has also assured the SC that till the apex court decides on the reservation, the counseling process will not take place. A bench headed by Justice DY Chandrachud had earlier said that if the consultation process takes place before taking a decision, “students will face a serious problem”.

“We will listen to you until the students are advised. We will accept your point that counseling is not going to start till we decide some way. Students will have a serious problem otherwise,” Justice Chandrachud had said.

The SC will also hear a petition filed by NEET MDS 2021 candidates challenging the implementation of the notification with effect from the academic year 2021-2022. The petition has also sought a direction to the Center to proceed with the NEET MDS counseling on the basis of the earlier reservation policy.
