Person earning Rs 53,000 per month gets IT demand notice of Rs 113 crore

New Delhi: A resident of Bhind in Madhya Pradesh with a monthly income of Rs 53,000 received a demand notice of Rs 113.83 crore from the Income Tax (IT) department for alleged transactions of Rs 132 crore in his account in 2011-12. According to the IT department, Ravi Gupta, a resident of Bhind, is the promoter of Tia Traders, a diamond trading company, which is registered as a firm in Surat and Mumbai.

The IT department also said that Gupta had Tax Identification Number (TIN) registration, service tax registration, check details of Tia Traders of RBL Bank and an Axis Bank account which was opened in Malad, Mumbai branch. Gupta, however, said that apart from the PAN copy and his photograph, nothing else belonged to him and that he was a victim of a huge fraud racket. It is learned that the PMO had launched a probe into Ravi Gupta’s case after it was first reported by ANI in 2020.

Despite this, Gupta has received another notice from the Income Tax Department on 28 March. Speaking to ANI, Gupta said that first, he received a notice from the IT department in 2019, asking him to pay a fine of Rs 3.49 crore for 2011-12. , He said that he was then working in a BPO in Indore and was drawing a monthly salary of only Rs 7,000. “At that time I thought that the IT department had sent the notice to him by mistake and asked the department to rectify it. But when I again received the notice for Rs 113,83,32,008, I was shocked.”

For the past five years, Gupta has been approaching central agencies in a relentless effort to clear his name. He said that he has since filed complaints with the Enforcement Directorate (ED) and the Central Bureau of Investigation (CBI) and was shocked that they did not investigate the matter despite coming to the fore. According to Gupta, the CBI Bhopal office forwarded his complaint to the Economic Offenses Wing (EOW) Gwalior and said, “I believe the EOW is probing the matter.”

Gupta said that though the investigation by the EOW is on, the Income Tax Department has again issued a demand notice last week, leaving no option but to appeal against the notice. I do not know when and where it will stop. ,

“If you fail to pay the amount of tax within the period specified above, a penalty (which may extend to the amount of tax outstanding) may be imposed after giving you a reasonable opportunity of being heard,” the notice said. As per section 221.” It further said, “If you wish to appeal against the assessment, you may prefer an appeal to the National Faceless Appeal Center (NFAC) under Part A of Chapter XX of the Income-tax Act, 1961. In Form No. 35, duly stamped and attested as prescribed in that Form, within thirty days of the receipt of this notice.
