Kanpur: Judge of Special POCSO Act Court Raj Veer Singh Accused’s bail application rejected on Tuesday RehanThe police have alleged physical abuse of a mentally challenged minor girl.
The court observed that though the victim admitted in her statement recorded under Section 164 of CrPC that the accused had entered into physical relations with her consent, but since she was less than 18 years of age, her consent as per the provisions of Section 375 had no meaning. Indian Penal CodeHence the offense committed by the accused was heinous.
Therefore, without making any comment on the merits of the case, the Court was of the opinion that there were no sufficient grounds for bail, hence the application for bail was liable to be dismissed. ADGC, Sushil Kumar VermaHe said that the victim’s father has said in his complaint that accused Rehan had physical relations with his mentally challenged 16-year-old daughter two-three times after which she became pregnant. He forced her to convert and when the girl’s family members protested, Rehan threatened to kill them and beat her son too.
The defense counsel argued that the accused had not committed any offense or offense against the victim or her father but in fact he had given her a loan of Rs 20,000. The complainant had implicated him so that he could misuse the loan amount. Since the accused is in jail since May 13 and is innocent, he should be released on bail.
