Rajasthan High Court asks NTA to temporarily admit Pakistani immigrant to medical college

The Rajasthan High Court on Tuesday asked the National Testing Agency to allot a seat in a suitable medical college to a Pakistani immigrant who had cleared NEET but was denied entry for a long-term visa from his country of origin. Justice Dinesh Mehta of the Jodhpur bench of the High Court asked the NTA, on a plea by Pakistani immigrant Sandeep Kumar, that the country’s premier body conduct competitive examinations for admission to various higher educational institutions, including engineering and medical.

Kumar had moved the high court saying that despite securing 80 per cent marks in the National Eligibility-cum-Entrance Test (Graduation) (NEET), he was denied a seat in a medical college as his LTV expired. and was awaiting renewal by Pakistan. Tall. Asking the NTA to admit Kumar to a medical college, the bench ruled that the validity of his admission would depend on the outcome of his plea. Giving relief to the petitioner, Justice Mehta said, the petitioner appeared in the NEET (UG) examination and secured 80 per cent marks.

It is hereby ordered that the competent authority of NEET shall allot a suitable college to the petitioner, certainly, as per his merit, ignoring the fact that he does not have a long term visa, the bench said. The order further states that the petitioner will be allowed to pursue his course subject to the final outcome of his writ petition.

Kumar had said that he is a Pakistani national and came to India with his parents and siblings in 2011 through a passport valid under LTV. He told the court that his visa had expired in October 2017 and the request for extension of his visa was pending with the authorities since then.

During the last hearing last August, Kumar had expressed his desire before the court to appear in the NEET exam, but was apprehensive that his writing application might be rejected in the absence of LTV. The court then asked the director and convener of NTA, Rajasthan NEET-UG Admission Board, Jaipur to accept their exam form. In its hearing on Tuesday, the court also gave four weeks time to Additional Solicitor General Mukesh Rajpurohit to file his reply.
