Rape FIR to be filed against BJP leader Shahnawaz Hussain, Supreme Court dismisses petition

BJP leader and former Union Minister Syed Shahnawaz Hussain has got a big blow from the Supreme Court. The situation of Surat will be against Shahnawaz Hussain. The Supreme Court has dismissed the petition against the decision to register the FIR and has upheld the decision of the Delhi High Court. The Supreme Court said that the petitioners can approach the High Court seeking quashing of the FIR. Earlier, the Supreme Court had stayed the order to register the FIR.

BJP leader Shahnawaz Hussain had approached the Supreme Court against the Delhi High Court and challenged the order registering the FIR for rape. In fact, in 2022, the Delhi High Court had said that a case of rape could be registered against BJP leader Shahnawaz Hussain. The Delhi High Court had ordered the police to file an FIR against Shahnawaz Hussain along with other documents including the charge sheet. The Delhi High Court had also directed the police to complete the investigation in three months.

The Delhi High Court had said that it is clear from looking at all the facts that there is complete reluctance on the part of the police to register the FIR in this case. The Delhi High Court had said that the report presented by the police in the court was not the final report. The court had rejected the police’s argument that the woman’s complaint constituted a cognizable offence.

The Delhi-based woman filed a petition in January 2018, filing a charge sheet against Hussain, to support the filing of the petition. The woman alleges that Hussain raped her at Chhatarpur farm house and threatened to kill her.
