Sameer Wankhede dismissed the petition against the FIR before the Bombay High Court; Thane Collector’s order also challenged. Mumbai News – Times of India

Mumbai: Former Zonal Director of Narcotics Control Bureau Sameer Wankhede filed a cancellation petition earlier on Monday Bombay High Court Against First Information Report (FIR) alleging fraud and forgery. The police on Saturday lodged an FIR against him after the Excise Department had allegedly fraudulently obtained the license of the bar two-and-a-half decades ago. Wankhede, who was on deputation to NCB, has been sent back to his parent department on completion of his tenure.
His petition is to be heard in the High Court on Tuesday. He argues that no cognizable non-bailable offense is made out against him and he can seek an interim order to protect against any coercion or arrest.
Wankhede has also filed a separate petition challenging the order, passing an oral order Commissioner State Excise Permanent cancellation of a foreign liquor license to Hotel Sadguru, refusing to stay the order dated 1/2/2022 passed by Thane Collector.
Thane Collector Rajesh Narvekar on February 1 had held that Wankhede had obtained the permit on October 27, 1997, through deliberate misrepresentation or fraud. Wankhede was a minor below the age of 18 at that time. His date of birth was not mentioned in his application.
Wankhede’s plea against the Thane order is based on the ground that the action has been initiated “under political pressure and personal vendetta” of minister Nawab Malik as his son-in-law was arrested by the petitioner.
Quoting a Supreme Court judgment, Wankhede’s plea to restore the FL lII licence, states, “Without any pressure from the State Government or other authority, freely and without any compulsion to exercise vested discretion on its own merits.” requires an administrative authority” that “the collector cannot shirk his responsibility and act on (Malik’s) instructions and political pressure. Malik has been made a respondent in the petition filed through advocate Vishal Thadani;
His plea said, “The action to revoke the license in 2022 after 24 years, on the ground that it has been obtained through misrepresentation in 1997, is hopelessly prohibited” and “the Collector under the Maharashtra Prohibition Act”. does not have a review”, 1949 and the licencee could not review its own order passed in 1997.”
The FIR against Wankhede for offenses under IPC sections 181 (false statement on oath before a public servant), 188 (disobedience to order duly promulgated by a public servant), 420 (cheating), 465 (punishment for forgery), 468 is for. Forgery with intent to defraud) and 471 (using genuine as a forged document).
NCP spokesperson and skill development minister Nawab Malik had lodged a complaint with the Central Vigilance Commission and the State Excise Commissioner. Malik’s argument was that it was wrong for Wankhede to hold a license, given the fact that he belonged to the All India Service, which he had joined in 2008.
