Samsung asked to fix faulty phone, pay compensation to the customer

Dakshina Kannada District Consumer Disputes Redressal Commission has directed Samsung India Electronics Limited to repair and compensate a defective mobile handset of a Puttur resident free of cost.

The commission has given this order on the complaint of Manoj Kumar, an employee of the finance company, resident of Irde of Bettampadi in Puttur taluk of the district.

Mr. Kumar purchased Samsung A315FW Galaxy A31 mobile at a price of ₹ 22,497 from Poorvika Mobiles showroom in Puttur in August 2020. As soon as the display of the mobile phone went off, he took it to an authorized Samsung Mobile Service Center Techno Care. The service center said that there was a problem with the motherboard of the mobile phone and it needs to be replaced after getting approval from Samsung India Electronics. Despite two months, the mobile phone was not repaired as the service center said that it has not received any communication from Samsung India Electronics.

Following the legal notice, Samsung India Electronics replied to Mr. Kumar on January 19, 2021, that it was ready to repair the mobile phone as a goodwill gesture.

Mr. Kumar filed a complaint with the District Commission seeking compensation for the lack of service by the company, which has sold a defective mobile phone handset and failed to rectify it even after furnishing it within the warranty period.

Appeared before the District Commission, Sandeep Sahijwani, Director, Customer Satisfaction, Samsung India Electronics Pvt. Ltd. in its affidavit stated that the service engineer noticed a defect in the motherboard of the mobile phone. Mr. Kumar was asked to bear the repair cost of ₹8,000. Mr. Kumar was not ready to bear the cost as the mobile phone was submitted for repair within the warranty period. Mr. Sahjwani also stated that not all service requests are covered under warranty free service and some service requests were exempted from it.

Terming the act as deficiency of service, the commission of Chairman K Prakash, members PV Lingaraju and HG Sharadma on 16 August directed the company to repair mobile phones free of cost. It also directed the company, showroom and service center to jointly pay Rs 10,000 towards compensation and litigation costs.
