SC is getting delayed in listing some cases, CJI DY Chandrachud said health of five judges is bad

Lawyers demanding early or urgent hearing of their cases were dealt a blow on Monday as several judges of the Supreme Court fell ill. Chief Justice DY Chandrachud said that five judges of the apex court were currently unavailable, assuring that their cases “will not be thrown out”.

“We had given some dates for the cases today. Members of the Bar can be assured that cases will not be thrown out due to non-availability of Judges. Five judges are unwell. We will list them on the next available date or the next miscellaneous date,” the CJI said.

A five-judge constitution bench hearing petitions to legalize same-sex marriages had earlier canceled a scheduled hearing after some judges were infected with COVID-19.

The top court is currently considering petitions seeking legal recognition of same-sex marriages. One of the petitions had earlier raised the absence of a legal framework that allowed members of the LGBTQ community to marry anyone of their choice. The petitioners also assert their fundamental right to marry each other and pray for appropriate directions from this Court to permit and enable them to do so. The Center has opposed the petitions.

The CJI also announced on Monday that on the occasion of the 50th anniversary of the Supreme Court’s landmark Kesavananda Bharti judgment that established the Basic Structure Doctrine of the Indian Constitution, the apex court has created a special web page containing the 13-judge opinions . bench.
