The Supreme Court Collegium has stamped the decision of two judges in the Supreme Court

The Supreme Court Collegium has blamed the central government for sealing the appointment of two judges in the Supreme Court. The Center suspects that this section has subscribed to the elevation of Allahabad High Court Chief Justice Rajesh Bindal and Gujarat High Court Chief Justice Arvind Justice Kumar to the Supreme Court. Justice KM Joseph, who was part of the collegium, objected to the name of Gujarat High Court Chief Justice Arvind Kumar, saying that his name (of Chief Justice Arvind Kumar) can be considered later. On 13 December 2022, the Collegium appointed Chief Justice of Rajasthan High Court Pankaj Mittal, Chief Justice of Patna High Court Sanjay Karol, Chief Justice of Sandeep High Court Justice PV Sanjay Kumar, Justice of Pune High Court Justice Ahsanuddin Amanullah and Justice of Allahabad High Court Manoj Mishra was to be made a Supreme Court judge. The Center is yet to approve his appointment.

(iii) gender diversity; And
(iv) representation of minorities has been made the norm
The appointment of five judges, whose appointment was decided on December 13, will be given first priority.

It is attached that there is a conflict between the Central Government and the Judiciary on the issue of appointment of judges. In fact, the Supreme Court Collegium has written a note to the Law Ministry. In this, the Center has been warned on the appointment of judges. The note has been added that if the collegium reiterates the classification of the name for doing the judge job, then the nomination will have to be approved by the government. On the other hand, Union Law Minister Kiren Rijiju has taken strong exception to the Supreme Court making public the government’s objections to the merger for judges. Last week, the Supreme Court Collegium, headed by Chief Justice of India Devaya Chandrachud, made public the government’s objections to the selection of three Indians for the judgeship on the SC website. His objection to the confrontation with the government was raised by the Supreme Court to highlight the claims of his intelligence lens—Research and Analysis Wing (RAW) and Intelligence Bureau (IB).

Speaking on the issue, the Law Minister had said, “The publication of confidential and sensitive reports of RAW or responsible is a matter of grave concern to which I respond at an appropriate time. In fact, the government, in the appointment of judges, has been pressing for a role that has been the domain of the Supreme Court collegium or panel of senior-most judges since 1993. The government’s argument is that the legislature is supreme because it represents the will of the people.
