Supreme Court notice to same-sex couple challenging High Court order

The Supreme Court on Monday issued notice to the respondents on a plea filed by a girl in a same-sex relationship, challenging the Kerala High Court order directing her partner to attend counseling sessions .

The Supreme Court stayed further proceedings in the Kerala High Court till the next date of hearing.

Earlier, same-sex couples moved the Supreme Court challenging the Kerala High Court order directing one of them to attend counseling sessions with a psychiatrist.

A bench headed by Chief Justice of India DY Chandrachud asked the counsel for the petitioner to keep the brief ready and said it would hear the matter at the end of the board.

Advocate Shriram P, counsel for the petitioner, referred to the petition seeking urgent hearing before the Supreme Court.

The petitioner challenged the January 13, 2023 order of the Kerala High Court, in which the High Court had directed one of them to attend counseling sessions with a psychiatrist as far as his sexual orientation was concerned.

In the petition, the same-sex couple stated that they are female as per their gender orientation and both want to get married and live together. But the detained person’s parents have kept the detained person in illegal custody against his will, so as to disrupt the marriage between the petitioner and the detained person, the plea said.

It further said that the petitioner is challenging, in letter and spirit, the interim orders dated January 24, 2023 and February 2, 2023, all of which deprived the petitioner of her fundamental rights. The petition states that these orders have denied security and liberty to those detained for a prolonged period from January 9, 2023 till date.

The petition states, “The present Special Leave Petition, among many others, involves a substantial question of law. Whether the High Court should empower the detained person to be physically heard in the safety and security of the High Court building.” Was Needed.” Stating that the petition has also raised a question of law whether “gender oriented counselling” is legal or not.
