Form of words:

Panaji: The Goa government told a Bombay High Court bench here on Wednesday that the victim in the 2013 rape case, in which journalist Tarun Tejpal was acquitted, was named and shamed and that the trial court’s decision was “regressive” and “regressive”. Suitable for the fifth century”.

The Goa bench of the HC, comprising Justices Revathi Mohite Dere and MS Jawalkar, later adjourned the matter till November 16, when it will hear Tejpal’s application, seeking the state government’s appeal against acquittal in the case. The sustainability of the appeal was challenged.

Solicitor General of India Tushar Mehta, representing the Goa government, said before the bench that the accused (female) had been “named and shamed”. He termed the lower court’s ruling as “regressive” and “fit for the fifth century”.

Justice Dere said that not only in this case but in all cases of rape, we will not allow lawyers to read the evidence, we will read it ourselves.

He said that a lawyer can state the page number while submitting the evidence.

On May 21 this year, a sessions court acquitted Tejpal, the former editor-in-chief of Tehelka magazine, in a case where he was accused of sexually assaulting his then colleague in the lift of a five-star hotel in Goa in November. Was. 2013 when they were attending an event.

Later the Goa government filed an appeal against it in the High Court.

The matter came up before a division bench of the High Court on Wednesday when Tejpal’s counsel Amit Desai presented the court for consideration of two applications filed by him.

Tejpal has challenged the hearing of the Goa government’s appeal against the acquittal in the case. Desai said the state government had not allowed the public prosecutor to file the application (challenging the order of the sessions court) on the day of filing of the application.

He also said that he has filed an application for an ‘in-camera’ hearing of the matter, which was opposed by Mehta. The bench will later hear Tejpal’s plea for in-camera hearing in the matter.

On Wednesday, the hearing took place in virtual mode.
