According to the petitioners, the demolition was against the law as the house did not belong to Javed but belonged to his wife Parveen, who had received it as a gift from her parents even before marriage.
Javed Mohammad was arrested on the intervening night of June 10 in connection with an FIR registered at Khuldabad police station in Prayagraj district for his alleged role in the violence that took place on the same day.
The Prayagraj Development Authority (PDA) on June 12 bulldozed his house at JK Ashiana in Kareli area of ​​Prayagraj citing illegal construction without the approval of the map.
Since Javed had no ownership of the land and the house, the attempt to demolish that house was against the basic principle of law and gross injustice was done to his wife and children, the petitioners further said.
The petitioners submitted that the PDA had pasted a notice on the wall of Parveen Fathima’s house on June 11, 2022 and in the said notice some retrospective date was mentioned regarding issuance of show cause which was never received. by Javed Mohammed or his wife Parveen.
The petitioners have alleged that the statutory and mandatory provisions were not followed and 30 days time was not provided to appeal. The house was demolished in one day, that too on the second Saturday before Sunday.
