20-year-old host agrees to give birth, Supreme Court allows abortion

The Supreme Court on Thursday agreed to give birth and adopt the child at AIIMS, a 20-year-old host of engineering science, to allow the adoption of her pregnancy of about 30 weeks. The petitioner before Chief Justice DY Chandrachud perused the All India Institute of Medical Sciences (AIIMS) report and submitted that abortion is no longer safe at this stage and that the woman is about to deliver a child. Earlier, AIIMS was directed to explore the possibility of safe abortion.

Taking note of the speculation of the matter, a bench of Justices Chandra Chud, Justices Murat PS Narasimha and Justices JB Pardiwala asked Solicitor General Tushar Mehta, Additional Solicitor General Aishwarya Bhati and the woman’s counsel to discuss the issue of the unborn fetus and its parentage after birth. Called in the chief justice’s chamber for a huge discussion to decide on the adoption, as the unmarried woman said she would not be able to take care of the child.

Invoking the extraordinary powers under Article 142 of the Constitution, the petition said, “The request for the birth certificate of the child shall be recorded by AIIMS on behalf of the court. ,

The bench said, “We request the director to ensure that necessary facilities are assured without any charges so that our existence remains in a secure condition.”
