Airlines will reimburse passengers for involuntary seat downgrades

Airlines in India will have to reimburse a passenger who has been involuntarily downgraded on a flight, according to the latest amendment to civil aviation norms by Indian aviation regulator Directorate General of Civil Aviation.

The regulator has said that with the amendment, a passenger who is involuntarily downgraded and taken to a class lower than the class for which the ticket was purchased, will be reimbursed by the airline.

Under the new rules, airlines will be required to reimburse 75% of the ticket cost including taxes if a passenger is downgraded to a lower class seat on a domestic flight.

In case of international flights, a passenger will be reimbursed 30% of the cost of the ticket including taxes for flights up to 1500 kms. If the distance covered by an international flight is between 1500 km and 3500 km, the airlines will reimburse 50% of the cost of airfare to the passenger and if the distance is more than 3500 km, the airlines will reimburse 75%. The regulator has amended its Civil Aviation Requirement (CAR) Volume-3, Series M Part IV “Facilities to be provided to passengers on account of denial of boarding, cancellation of flights and delay in flights” so that the affected air passengers rights can be strengthened. The regulator had proposed the amendment in December in view of the rapid expansion of air services on international routes to and from India and the increase in the volume of passenger traffic.

For example, when a passenger who has booked his/her ticket on first class, business class or premium economy is downgraded to a lower class at the time of check-in due to various reasons like unusable seats, change of aircraft, overbooking, etc. said the regulator.
