Allahabad High Court News: Free speech does not include abusing the PM. Allahabad News – Times of India

Prayagraj: Observing that “the Constitution recognizes freedom of expression, but this right does not extend to abusing the PM and other ministers”, the Allahabad High Court has refused to quash one. FIR One filed against Mumtaz Mansoori of Jaunpur. Mansoori booked for making derogatory remarks against PM Narendra Modi, Home Minister Amit Shah Other ministers on social media.
Dismissing Mansoori’s petition, a division bench of Justice Ashwini Kumar Mishra and Justice Rajendra Kumar Said, “Though the Constitution of this country recognizes freedom of speech with every citizen, such right does not extend to making abusive or derogatory remarks against any citizen, even India The government is not even for the prime minister or other ministers (sic).”
In the FIR lodged in 2020, it was alleged that Mansoori had made highly derogatory remarks against Modi, Shah and other Union ministers. He was booked under IPC section 504 (intentional insult with intent to provoke breach of the peace) and section 67 (punishment for publishing or transmitting obscene material in electronic form) of the IT Act.
After this a criminal case was registered against Mansoori at Mirganj police station. Challenging the FIR, Mansoori had approached the High Court to quash it.
However, refusing to quash the FIR, the court dismissed the writ petition on 15 July, observing: “The FIR clearly discloses commission of cognizable offence. We need to quash such petition. No good ground is found to interfere with the present writ petition filed with the prayer of the FIR. The authorities shall be at liberty to proceed in the matter as per law and conclude the investigation at the earliest.”
