‘Allow hijab to match uniform colour,’ students request Karnataka HC India News – Times of India

New Delhi: Students from Karnataka, who moved the court against the state government’s order banning hijab in classrooms, on Monday requested permission to wear hijab matching the color of the school uniform.
Advocate appearing for the petitioners Devdutt Kamati Told a full bench of the Karnataka High Court that even Kendriya Vidyalayas like Kendriya Vidyalaya allow hijab in the classroom.
“Head carving is an essential religious practice, and prohibiting its use is a violation of Article 25 of the Indian Constitution,” Kamat said.
According to Article 25 of the Constitution of India, “Subject to public order, morality and health and the other provisions of this Part, all persons have the same right to freedom of conscience and the right to profess, practice and propagate religion.”
It further states that it shall not affect the operation of any existing law or prevent the State from making any law regulating or prohibiting any economic, financial, political or other secular activity which is connected with religious practice. and may regulate or prohibit any economic, financial, political or other secular activity which may be connected with religious practice.
Kamat also argued that the college committee that did not allow the hijab in classes is “an extra-constitutional authority and a third party”, and cannot decide on dress codes.
He pointed to the fact that some Muslim girls have been wearing the hijab since entering college two years ago. The current controversy began when some other students began sporting a piece of cloth, which is believed to have a religious reference.
The court will hear again on Tuesday.
High schools in Karnataka reopened on Monday amid prohibitory orders in sensitive areas of Udupi and Dakshina Kannada and Bengaluru after being closed for a few days over the hijab controversy.
The controversy started in late December last year when some girl students in hijab were denied admission to a government pre-university college in Udupi. As a counter, some Hindu students came out wearing saffron scarves.
The High Court of Karnataka in its interim order is pending consideration of all the petitions relating to hijab rowThe state government had requested the state government to reopen educational institutions and barred all students from wearing saffron shawls, scarves, hijabs and any religious flag inside the classroom.
