The Calcutta High Court on Monday refused to initiate contempt proceedings against Trinamool Congress (TMC) MP Abhishek Banerjee Comments targeting the judiciary,

A group of lawyers had filed a public interest litigation seeking contempt proceedings against the national general secretary of the party.

A division bench of Justice Sabyasachi Bhattacharya and Justice Krishna Rao observed that if the lewd comments are taken into account, it would become impossible for the judiciary to act, and dismissed the petition.

Court said it did not find sufficient reason to support suo moto contempt and that the remarks were made to defame it. However, it was noted that no case for contempt was made out and it was expected that those having influence on public opinion should restrain themselves from making any remarks that may belittle the prestige of the judiciary.

Mr Banerjee on Saturday alleged that they (judiciary) were ordering a probe by the CBI. “I am ashamed to say that there are one or two in the judiciary who are working hand in hand (with the Centre) as sticks, only one per cent of it. They are ordering a CBI inquiry at the drop of a hat.. A murder case is being put on hold. Have you heard anything like this?,” he said at a public meeting at Haldia in East Medinipur district.

Initiate action: Governor

Governor Jagdeep Dhankhar on Sunday Action sought from Chief Secretary For his remarks against Mr Banerjee.

On Monday, the Governor said that the Chief Secretary “should initiate all requisite action by June 06, 2022 and in relation to the public targeting of the judiciary by the Diamond Harbor MP (on the judiciary handing over investigations to the CBI in cases including the infamous SSC scam),” Those who can neither be ignored nor retaliated”. He also tweeted, “Orchestrated and synchronized targeting similar to that of a sitting judge seizing Nandigram election petition by Diamond Harbor MP and others in Sept 2021. ‘I have the right to criticize the verdict’

Mr. Banerjee Justifying his remarks on Monday, he said he has the right to criticize a decision and has full respect for the judiciary. “I have a right to criticize a judgement. If a judgment says that there will be no FIR in the murder case, is it right or wrong? If I say something about the judiciary, the governor reacts to that. This only proves that the comments have hit the right place. I have full respect for the judiciary,” he said at a rally in Shyamnagar in North 24 Parganas.

He observed that he did not name any judge or specifically mention any judgment and wondered why the governor remained silent when BJP leaders made controversial remarks against the chief minister.
