‘Children can’t be put at risk’ – SC halts Class 11 exams in Kerala amid Covid surge

New Delhi: The Supreme Court on Friday stayed for a week the Kerala government’s decision to conduct offline examinations for class XI starting from September 6 amid rising COVID cases.

The state is facing an “alarming” situation due to COVID-19, the top court said, adding that “cases in Kerala account for about 70 per cent of the country’s cases. Children of this age cannot be exposed to this risk.”

“Prima facie we find the force to be submitted by the petitioner that the State Government has not seriously considered the prevailing situation before the proposed physical examination in September this year. As we have not received satisfactory response from the State counsel in this regard, We grant interim relief by staying the offline examination till the next date of hearing,” said a bench of Justices AM Khanwilkar, Hrishikesh Roy and CT Ravikumar.

The top court has fixed September 13 for the next hearing of the matter.

The Kerala High Court had earlier observed that conducting the examination is a matter of government’s policy and does not require interference.

The apex court’s division bench passed this order on an appeal filed by advocate Rasoolshan A, challenging a decision of the high court which had refused to interfere with the decision to conduct the offline examination.
