congress leader Rahul Gandhi A complete hearing has been held in the Sessions Court of Surat on the petition seeking a stay on the 2-year sentence awarded by Rahul Gandhi in a criminal defamation case. The court has reserved the judgement. The verdict will be pronounced on 20 April. During the hearing, Senior Advocate RS Cheema Rahul Gandhi matter in front of the court.

Defamation cases are not appropriate – lawyer
The court had given exemption to Rahul Gandhi not to be present during the hearing. Rahul Gandhi’s lawyer argued in the court that the defamation case was not justified by commenting on Rahul’s Modi surname. Also, there was no need for maximum punishment in the case. Purnesh Modi, the petitioner in the case, gave his reply in the court, opposing the plea for a stay on Gandhi’s conviction, saying that the Congress leader was repeatedly accused of making defamatory statements.

Senior Advocate RS Cheema submitted that Section 389 of the Code of Criminal Procedure provides for suspension of sentence on appeal. He said that the authority is an exception but the court should consider considering the punishment. He said the court should consider whether the award of compensation would cause irreparable harm. Such punishment is unjust.

On March 23, Rahul Gandhi was sentenced to two years in a defamation case. Shortly after the sentence was announced, he was granted bail for 30 days. His membership was canceled with effect from 19 November, the very next day after the sentence was pronounced. He lost his membership after being found guilty.

Received free time notice
The Housing Committee had sent a notice to Rahul on March 27 to vacate the house. The committee asked him to vacate his official residence at 12 Tughlaq Road from April 22. Rahul has decided to stay at Sonia Gandhi’s residence by opening the enclosure. His stuff has also changed.

Rahul had two petitions for kicking
Rahul Gandhi had filed a main petition in the court and made 2 applications. The trial judgment was challenged in the main petition. While the first of the two applications was for a stay of conviction, the second was for a stay of sentence.
