In his application presented during the last hearing, Gandhi said that being a Member of Parliament (from Wayanad in Kerala), he has to visit his constituency, attend party work and travel a lot, therefore He is exempted from appearing in person before the court. ,
His lawyer Narayan Iyer said that Gandhi has also said in his application that whenever necessary, he should be allowed to be represented by his lawyer in the hearing. Acting on Rahul Gandhi’s permanent exemption application, the court had asked the complainant to present his case on Saturday.
On Saturday, Gandhi also moved an application seeking exemption from appearance for one day as her mother is hospitalized due to symptoms of COVID and hence she has to take care of the mother, which was allowed by the court.

In 2014, Kunte had filed a case against Gandhi after watching Gandhi’s speech in Bhiwandi Basti, where the Congress leader alleged that the Rashtriya Swayamsevak Sangh (RSS) was behind the assassination of Mahatma Gandhi.
Kunte had claimed that the reputation of the RSS had been hurt by this statement.
In 2018, the court had framed charges against Gandhi in the case, but he pleaded not guilty.
