Delhi High Court suspends remaining jail term of former Sashastra Seema Bal DIG

He has already served 13 months of imprisonment out of 18 months given by the SSB court

The Delhi High Court has suspended the remaining sentence of a former Deputy Inspector General of Sashastra Seema Bal (SSB), who was sentenced to 18 months’ imprisonment after being found guilty of certain irregularities while in service.

A bench of Justice Manmohan and Justice Navin Chawla said that former DIG Upendra Prakash Balodi has already served 13 months of imprisonment out of 18 months.

The bench, while seeking response from the Center and the SSB on Balodi’s plea, said, “This court directs to adjourn the sentence till further orders.”

Balodi was accused of irregularities in the purchase of horse fodder and liquor when he was posted as DIG in Srinagar. The General Forces Court of the SSB then sentenced him to dismissal from service and to 18 months of rigorous imprisonment.

The order was later modified to the extent that the ‘punishment for dismissal from service’ was changed to ‘compulsory retirement from service’ and the sentence of 18 months imprisonment remained unchanged.

Balodi challenged the order holding him guilty, and sought a direction to the authorities to reinstate him in service with all consequential benefits, including promotion, with effect from February 1, 2020. Balodi said he was appointed as an assistant commandant in the SSB in 1987. And finally promoted as DIG in 2011.
