Delhi woman’s family ‘cut off husband’s penis’, couple wants case quashed, prosecution opposes

The couple – Delhi residents Raman and Maneka, both now 23 – tied the knot in Jaipur in December 2021 after three years of relationship., Maneka’s family was against Raman from the beginning.

The day they returned to Delhi, Maneka’s family allegedly kidnapped and thrashed the two. According to the FIR and medical report filed on December 23, 2021, the family also severed Raman’s penis from his body.

After this, an FIR was lodged on behalf of Raman at Rajouri Garden Police Station. Under other provisions including kidnapping, attempt to murder and criminal conspiracy. However, in February this year, the accused filed a petition under section 482 A demand has been made to quash the case against him under the Code of Criminal Procedure (CrPC).

Section 482 talks about the inherent powers of the High Court to pass such orders as may be necessary to prevent abuse of process of any court or to secure the ends of justice. This provision also allows the High Court to quash any case it deems fit.

In response, the prosecution filed a status report in the case earlier this week, and has also opposed the quashing plea. Additional Public Prosecutor Tarang Srivastava called it “one of the most reprehensible crimes”.

He told ThePrint, “The boy was brutally assaulted and his private parts were chopped off and thrown away. He was left to die and the girl was kept in captivity. The police have provided security to the couple, but somehow the people of the community are influencing them to compromise and compromise. The police is strongly opposing this petition.”

He asserted that “crimes of such nature have no place in a civilized society” and said the prosecution would ensure that the case reaches its logical end and the culprits get “severe punishment”.

The status report filed by the prosecution also states that round-the-clock security is being provided to the couple. The matter is scheduled to come up before the High Court on July 18.

Police has arrested 17 people attempted murder The case and three accused are absconding. The trial court has framed charges in the case and the matter is listed for hearing on September 2 this year.

Maneka was allegedly kept in wrongful confinement by her family members from December 22, 2021 to March 6, 2022.

‘Maintain Healthy Relationship’

The quashing petition, seen by ThePrint, now states that the matter was “settled with the intervention of the family, relatives and the panchayat of the Sansi community” in April last year. According to the petition Maneka was pregnant and was Delivery is expected sometime in June this year.

The settlement agreement, seen by ThePrint, states that the family members of Menaka, who had cut off Raman’s penis, would give an undertaking that they would bear the cost of his treatment. It directs the family to arrange Rs 12 lakh for the treatment and “bear additional expenses up to Rs 1 lakh”.

The petition states that the accused followed the instructions of the panchayat, paid the treatment and compensation and the family has also accepted their marriage.

“No worthwhile purpose would be served by keeping the matter alive as it has been amicably settled between the parties,” the plea claimed. The object of the petition is to “maintain harmony and good/healthy relations between the parties”.

The petition also includes affidavits by Raman and Maneka, which states that “with the intervention of relatives and friends, the above matter has been settled amicably on 3rd April”. None of them is under any threat, pressure or duress to enter into such an agreement.

The affidavit states that the matter was a “family dispute” between the parties.

However, in March last year, Maneka told the trial court that she did not want to live with her family and wanted to live with her husband. “I fear for my life from my parents,” he said in a statement seen by ThePrint.

The matter first came up before the High Court on February 27, when some members of the accused family and the couple were present in the court. Upon questioning by Justice Anup Jairam Bhambhani, Raman told the court that he had, in fact, settled the dispute with the petitioners “under the aegis of the Community Panchayat”, the high court order said.
