DMK files review petition on SC verdict upholding EWS quota

by Srishti OjhaDravida Munnetra Kazhagam (DMK) has filed a review petition in the Supreme Court to review its decision to retain 10% quota for economically weaker sections.

According to sources, the state of Tamil Nadu may also file a review petition for the same.

Tamil Nadu’s ruling party DMK has said in its review petition that the Supreme Court never examined how “forward castes” can be termed as “weaker sections” benefiting from the challenged constitutional amendment as they Not financially strong.

It is also stated that the Court in its impugned judgment did not consider that the only data available with the union for reservation purposes was the Sinho Commission report, and that the report was not empirical.

In the petition, the party also said that the decision was discriminatory as it excluded the poor belonging to Scheduled Tribes, Scheduled Castes and Other Backward Classes from the 10% reservation, hence violating the Equality Code.

The DMK also presented an argument that the SC did not fully consider the historical and social advantage of the forward castes.

A Constitution Bench of the apex court by a majority of 3:2 recently upheld the validity of the 103rd Constitutional Amendment providing 10 per cent quota to the Economically Weaker Sections (EWS).

Former Chief Justice of India (CJI) Lalit, along with Justice S. Ravindra Bhat in his minority opinion held the EWS quota to be unconstitutional to exclude backward classes.
