E-gaming federation to challenge Tamil Nadu ordinance banning online gaming

New Delhi, October 19: The e-gaming federation will challenge the ordinance issued by the Tamil Nadu government to ban online gaming as it classifies rummy and poker as games of chance, the industry body said on Wednesday. The E-Gaming Federation (EGF), whose members include Games24x7, MPL, Junglee Games etc., cited the Supreme Court order, which has decided rummy as a game of skill, according to the industry body.

The EGF said in a statement, “Bringing rummy into the purview of games of chance is in direct violation of the Supreme Court’s decision and the Madras High Court’s decision that overturned a law banning online games, including rummy and poker. ” Tamil Nadu had issued an ordinance to prohibit online gambling and regulate online gaming in the state and said that an online gaming authority would be set up to exercise the powers conferred by this ordinance.

The authority will regulate online games, issue certificates of registration to local online game providers, besides identify online games of chance rummy and poker and monitor the functioning of online game providers in the state. “After examining the ordinance, we have decided to file suit because it classifies rummy and poker as games of chance.

This is inconsistent with a number of statutory judicial pronouncements, including the recent judgment of the Madras High Court, which clearly separated the game of skill and chance. EGF CEO Samir Barde said, “The Supreme Court and several high courts have reaffirmed the status of skill-based sports as a legitimate commercial activity and the state should take cognizance of these decisions in developing an efficient gaming policy. Who protects the players.” said in the statement.

EGF said the need of the hour is a comprehensive online gaming policy that protects players and ensures that only legitimate online skill-gaming operators offer their services while weeding out lawbreakers. The industry body said that the Indian gaming market is expected to grow to US$ 5 billion in revenue by 2025 from the current US$ 2.2 billion.
