The Delhi High Court has dismissed a petition alleging mismanagement in the Delhi Public School Society (DPSS) and sought the appointment of a retired Supreme Court judge as an administrator to oversee its affairs. The High Court observed that the petitioner has been continuously seeking a probe and he does not see any reason to grant the relief sought in the PIL. A bench of Chief Justice Satish Chandra Sharma and Justice Subramaniam Prasad, while referring to the petition for removal of the president and other office bearers of the society, observed that it could not be done at the behest of the petitioner, and that too without the persons seeking removal. Went to hear them.

The petitioner had alleged mismanagement in the DPSS elections and prayed for the suspension of the society’s president, vice-president and working committee. It also sought to appoint a retired Supreme Court judge as administrator. The bench said, “In the considered opinion of this court, the petitioner wants a continuing inquiry in respect of DPSS. He wants to suspend the chairman, vice-chairman, working committee without implicating them as defendants, and he wants a retired Supreme Court judge to take over the administration of the society.

This Court is of the considered view that such relief cannot be granted to the petitioner in a PIL, and if there is an election dispute, the same can be seen before the appropriate forum and not in the PIL filed in the PIL . The petitioner, who has filed the PIL, dismissed the petition saying. The petitioner had also sought a forensic audit of the accounts of the society and an order to freeze its bank account.
