HC issues notice to Centre, Delhi government on PIL challenging provision of RTE Act

The Delhi High Court has issued notice to the Center and the Delhi government on a Public Interest Litigation (PIL) challenging the provision of the Right to Education Act (RTE) 2009.

The petition, filed by advocate Ashwini Kumar Upadhyay, challenged the RTE Act 2009 and sought introduction of uniform curriculum and curriculum for children across the country. The petitioner sought directions to bring madrasas, Vedic pathshalas and educational institutions imparting religious education under its ambit. Act.

A bench of Justice DN Patel and Justice Jyoti Singh sought response from the Central Government and the Delhi Government and listed the matter for March 30, 2022.

According to the petition, Sections 1(4) and 1(5) deny educational excellence to madrasas, Vedic pathshalas and educational institutions imparting religious education. Consequently, the petition has sought a direction to declare the relevant sections of the Right to Education Act 2009 as arbitrary, irrational and violative of Articles 14, 15, 16, 21, 21A of the Constitution.

The petition was filed by Ashwini Upadhyay in the Delhi High Court after the Supreme Court refused to hear the matter and advised the petitioner to move the High Court.

The petition further states that the right of children should not be limited to free and compulsory education only but should be extended to equal quality education without discrimination on socio-economic, religious-cultural background, thus common curriculum for all children.
