The Jharkhand High Court recently pulled up the police officers of Bihar and Jharkhand for “not following the norms to arrest a person” and asked the Jharkhand chief secretary to be a party to the case.

The court was hearing a habeas corpus petition seeking to trace the whereabouts of Jharkhand High Court Additional Public Prosecutor (APP) Rajneesh Vardhan, who was allegedly arrested by Patna Police with the help of his Jharkhand counterparts on November 7. was arrested from his residence. A division bench of the Jharkhand High Court, Justices Sujit Narayan Prasad and Anand Sen, questioned the police officers of Bihar and Jharkhand for “not following the norms established in law for arresting a person” and asked them to show cause. .

Mr Vardhan’s wife Sweta Priyadarshini had filed the writ petition stating that “despite our repeated requests, the policemen did not explain why or in what case her husband was being taken”.

“A team of Patna Police along with personnel of Sukhdevnagar police station in Ranchi entered our house on 7th November at 10.30 pm and beat up my husband while forcibly taking him in a vehicle. They did not tell us why and in what case they were taking her”, Ms Priyadarshini said.

The High Court found that Mr Vardhan was “kidnapped” by the police and was not arrested in accordance with law.

Hemant Kumar Shikarwar, a member of the Jharkhand State Bar Council, condemned the manner in which the Additional Public Prosecutor was taken away by the Patna Police with the help of his Jharkhand counterpart, saying, “There is a need to check the arbitrariness of the police and the police should take this action.” Refrain from. such illegal acts”.

‘Broken the rules’

Naveen Kumar, secretary of the Advocates Association of the Jharkhand High Court, said the police violated the procedures to be followed while arresting a person and such arbitrariness “cannot be accepted”.

Shri Vardhan is an advocate of Jharkhand High Court since 2003. After hearing the petition, the court ordered the Chief Secretary to be a party to the case.

The next hearing has been fixed for November 25.
