Karnataka hijab ban row: Girls move SC for permission to appear for exams in headscarf

The apex court today said it would decide on listing of a plea seeking permission to appear for examinations in government schools in Karnataka wearing hijab to girls.

Advocate Shadan Farasat apprised the bench headed by Chief Justice of India DY Chandrachud about the split decision of the Supreme Court. hijab issue And hence Muslim girls are not allowed to enter colleges wearing headscarf.

“They are wearing headscarves. If they wear headscarf they are not allowed inside the examination hall. It is only on this limited aspect that the court may consider listing it on Monday or Friday.

Advocate Farasat submitted that he has moved an intervention application praying only to allow the girl student to appear in the examination wearing a headscarf.

He said that the students have lost one year. He also told the court that the examinations are starting from March 9.

Advocate Farasat told the bench, also comprising Justice PS Narasimha, that due to the ban on wearing hijab, some girls have gone to private institutions, but they will have to appear for their exams in government institutions. He said he risked losing another year if the permission was not granted.

The CJI said, “I will call.”

Due to the split verdict, the decision of the High Court is still in the field.

The split verdict on October 13, 2022 stalled a permanent resolution to the hijab dispute as both the judges suggested placing the matter before a larger bench for adjudication.

The court had last month said it would consider setting up a three-judge bench to decide the case related to the ban on wearing hijab in government schools in the state.
