Lucknow: The Lucknow bench of the Allahabad High Court on Friday deferred the hearing on the bail plea of ​​Ashish Mishra, son of Union Minister of State for Home Ajay Mishra alias Teni, in the Tikunia case.
A bench of Justice Krishna Pahal fixed July 11 as the next date of hearing on the bail plea.
It was argued on behalf of the complainant that the bail applications of co-accused Ankit Das and others have already been rejected by the court.
Referring to the statements of the witnesses, it was further argued that the driver of the taxi in which co-accused Ankit Das had left Kheri, gave a statement to the police that on the way Ankit Das was talking on the phone about the said incident. From his conversation, the driver inferred that the allegations against Ashish Mishra were true.
The arguments continued but the court had to adjourn the matter till July 11 due to paucity of time.
Ashish’s convoy had allegedly crushed four farmers and a journalist on October 3, 2021. The FIR was initially registered under sections 302 (murder), 147 (rioting), 148 (rioting with deadly weapons), 149 (offence in prosecution). Common object), 279 (rash driving), 338 (so haste to cause grievous hurt to any person), 304A (negligent death) and 120B (criminal conspiracy) IPC.
On December 14, the SIT submitted to the court that the incident was “a pre-planned and not an act of negligence. The court later dropped the sections relating to “accident” from the FIR and struck down Section 307 (attempt to murder). Incorporated.
