The Madras HC said the Center had approached the apex court after the Supreme Court required approval for the 10 per cent reservation given to EWS in all India quota seats in medical college.

The Supreme Court will hear the petition of the Central Government regarding the implementation of the Economically Weaker Section (EWS) quota in medical college admissions. The Center then approached the apex court Madras HC observed that 10 percent reservation given to EWS All India Quota (AIQ) seats of a medical college will require approval by the Supreme Court.

The Madras HC on August 25 had approved the Centre’s July 29 notification regarding 27 per cent OBC reservation for admission in medical colleges under the All India Quota (AIQ). However, in the same observation, it was noted that 10 per cent EWS reservation beyond the 49 per cent limit on reservation would require approval from the Supreme Court and till then any reservation for EWS should be considered permissible. The Madras High Court made these observations while disposing of a contempt petition of the Dravida Munnetra Kazhagam (DMK) against the Centre.

The DMK had approached the Madras High Court indicating non-compliance with the court order and sought 50 per cent reservation for OBCs as almost all the seats were from government colleges. While the reservation limit is 49 per cent, in Tamil Nadu it is 69 per cent – 50 per cent for OBCs, 18 per cent for Scheduled Castes and 1 per cent for Scheduled Tribes.

Opposing this observation of the Madras HC, the Center approached the SC on September 3 and its plea will now be heard by a bench of Justices DY Chandrachud and BV Nagarathna.

Additionally, the apex court will also hear separate petitions filed by Neil Aurelio Nunes and Yash Tekwani. In these petitions, the implementation of 27 percent reservation in medical colleges was challenged and notice was issued to the central government in this regard.

The petition has sought quashing of the July 29 notification of the Center announcing the reservation policy.

Narendra Modi-led government approved Reservation for OBC and EWS students in AIQ for Medical Admission. Students who qualify the exam after clearing NEET (both UG and PG) have to appear for counselling. Counseling takes place at both the central and state level. 50% of PG and 15% of all UG seats come under Central Quota or All India Quota. The new reservation will be added in the AIQ segment.
