The Bench said that the applicant submitted that as per a report submitted by the Union Ministry of Environment, Forest and Climate Change, the encroachments by TANGEDCO were obstructing the natural flow of water in the Nallah and the river and that the approach road no. was. “Thus we find that even as per the stand of TNPCB, the reports of MoEF&CC and the Joint Committee are indisputable with respect to the factual position prevailing at the time of the said report. The compensation, therefore, needs to be determined for the said violations on the principle of ‘polluter payment’,” the bench said.
