No relief to Azam Khan’s son: Supreme Court dismisses plea in fake birth certificate case

The Supreme Court on Monday dismissed a plea by Samajwadi Party leader Azam Khan challenging the Allahabad High Court’s order refusing to quash the chargesheet in the fake birth certificate case of his MLA son.

SC BenchJustices Hemant Gupta and Vikram Nath, including Justices Hemant Gupta, found no reason to impede the HC’s order.

“However, any observation and discussion passed by the High Court shall not be prejudicial to the suit which the appellant is to face,” the bench said.

Senior advocate Kapil Sibal, appearing for Azam Khan, submitted that the HC wrongly relied on the findings of the Election Commission while refusing to quash the charge sheet.

Responding to Sibal’s argument, the top court said that the trial court has to examine the evidence in this case.

Two alleged fake birth certificates issued to Azam Khan, his wife Tazeen Fatima and son Abdullah Azam Khan Abdullah, one from Lucknow and the other from Rampur, were in jail in a criminal case registered against them.

An FIR was lodged by BJP leader Akash Saxena at Ganj police station in Rampur on 3 January 2019 against Abdullah, the sitting MLA from Uttar Pradesh’s voice. He alleged that Azam Khan and his wife helped their son get two fake birth dates. certificate.

This was not the first case when Abdullah was accused of playing with the age eligibility prescribed by the Election Commission for the assembly elections. Abdullah Azam was elected to the state assembly in the last elections as well, but Allahabad High Court canceled the election on the ground that he was below the required age of 25 years at the time of filing of nomination.

Azam Khan, 10 times MLA Rampur Most prominent Muslim politicians in the assembly constituency and the state were jailed for 27 months in several cases including land grabbing. He was granted interim bail by the Supreme Court in May this year in a cheating case.

Earlier this month, Enforcement Directorate (ED) had summoned the wife and son of the veteran SP leader for questioning in the money laundering case against him.
