Mohan, a former MP, is serving a life sentence for the 1994 murder of the then District Magistrate of Gopalganj, G Krishnaiah, a young IAS officer hailing from Mahbubnagar in present-day Telangana.

In October 2007, a court awarded death sentence to Mohan, which was later commuted to life imprisonment by the Patna High Court in December 2008 on appeal against the lower court’s decision.

The Nitish Kumar government on April 10 amended the Bihar Prison Rules, 2012, removing the clause “murder of a public servant on duty” from the list of cases for which remission of jail term cannot be considered.

Legal experts believe that the amendment could lead to the early release of Mohan, who is currently serving a sentence in Saharsa Jail for the last 15 years.

Criticizing the move to amend the rules, former Uttar Pradesh Chief Minister Mayawati recently tweeted, “Bihar’s Nitish government to release Anand Mohan in the brutal murder case of a very honest IAS officer from a poor Dalit. Ready to change. The community from Mahbubnagar, Andhra Pradesh (now Telangana) is in the news among a lot of Dalit people across the country for negative anti-Dalit reasons.” He said the move has hurt the sentiments of Dalit people across the country.

Describing it as a “pro-crime and anti-Dalit” work of Nitish Kumar, Mayawati urged the Bihar government to reconsider its decision.

Reacting to Mayawati’s allegations, senior JD(U) leader and state Rural Development Minister Shravan Kumar told PTI, “The state government takes decisions keeping in mind the welfare of all sections of the society.” Or benefit to a particular person… All decisions are taken according to the law. The stand of our CM is very clear… He has been working for the upliftment of all sections of the society. Mayawati should worry about UP, where there is no rule of law,” he said.

Another senior JD(U) leader and state finance minister Vijay Kumar Chowdhury took a similar view, saying that Mayawati has no moral right to comment on Nitish Kumar as he has neglected Dalits and other weaker sections of the society. Santosh Kumar Suman, Minister of State for Minor Irrigation and SC/ST Welfare and leader of the Grand Alliance constituent Hindustani Awam Morcha (WE), told reporters, “His (Anand Mohan) release should not be made a political issue. The Grand Alliance government is working for the welfare of all sections of the society. serve a jail term for a certain period,” he said.

Mehboob Alam, leader of the CPI(ML) Liberation Legislature Party in the Bihar Legislative Assembly, supported Suman and said that the release of Anand Mohan on humanitarian grounds was within the ambit of the law.

“Our party is demanding the release of political prisoners and those convicted under the Terrorist and Disruptive Activities (Prevention) Act or TADA, as the Act is no longer in force,” he said.

State RJD spokesperson Mrityunjay Tiwari alleged that Mayawati was working at the behest of the BJP.

“The Nitish Kumar government is doing excellent work for the welfare of the weaker sections of the society,” he said.

The Grand Alliance in Bihar comprises seven parties – JD(U), RJD, Congress, CPI(ML) Liberation, CPI, CPI(M) and HAM – which has more than 160 MLAs in the 243-strong assembly.
