Ordinance row: BJP said, Arvind Kejriwal did not react to Supreme Court’s decision

Delhi Chief Minister Arvind Kejriwal has not read Supreme Court’s decision In the matter of Center vs Delhi government, said BJP leader Amit Malviya on Saturday. The Supreme Court ruled that if the Lieutenant Governor of Delhi is given the power to nominate aldermen to the MCD, it would mean destabilizing an elected civic body.

Malviya said on Twitter, “There is no reason to spend so much energy on the ordinance brought by the central government with respect to Delhi.”

“Had Arvind Kejriwal read the judgment of the Supreme Court, he would have known that the said Ordinance, which was later to be taken up as a Bill by the Parliament, has its origin in the Constitution Bench (CB) judgment itself, which in Para I have in my winding up order. 164 ‘C’ and ‘F’ gives legislative competence on all matters in the Concurrent and State Lists in respect of the National Capital Territory of Delhi (NCTD)…,” he further wrote in a tweet.

He also told what is Para 164 ‘C’ and Para 164 ‘F’ in the Constitution. “Para 164 ‘c’ reads,” The Legislative Assembly of the NCTD is competent to enumerate the entries in List-II and List-III except the entries expressly excluded from List-II. Apart from the entries in List-I, Parliament has legislative competence on all matters in List-II and List-III with respect to NCTD…,” the BJP leader tweeted.

“Para 164 ‘f’ reads, “The executive power of the NCTD in respect of the entries in List-II and List-III shall be subject to the executive power expressly conferred on the Union by law enacted by Parliament.”

“In promulgating this Ordinance, the Central Government has exercised the powers conferred on it in relation to the governance of Delhi – the capital of India and a Union Territory, as described in the Constitution of India, as well as in the decision of the CB Even the Supreme Court,” Malviya said.

Meanwhile, BJP spokesperson Gaurav Bhatia also defended the move and said it was in line with the Constitution and in line with the Supreme Court’s observations in the matter.

He launched a scathing attack on Kejriwal after condemning him center to bring ordinanceWho wants to nullify the apex court order giving power over officials to the elected government saying that his ideology is against the constitution and is anarchic.
